In Portugal, Decree-Law no. 15/93, of 22 January, which defines the legal regime applicable to the trafficking and consumption of narcotic drugs and psychotropic substances, and Regulatory Decree No. 61/94, of 12 October, which establishes the rules relating to the control of the lawful narcotic drugs, psychotropic substances, precursors and other chemicals susceptible to use in the manufacture of drugs, included in Tables I to VI attached to Decree-Law No. 15/93, of 22 January. These diplomas prohibit the cultivation of hemp (Cannabis sativa L) without exception the cultivation of varieties that are destined for industrial purposes. However, the most recent legislation (Law No. 8/2019, 23rd amendment to Decree-Law No. 15/93 of 01/22, which approved the legal regime applicable to trafficking and consumption of narcotic drugs and psychotropic substances, and which transposed the Directive ( EU) 2017/2103, of the European Parliament and of the Council, of 15 November, provides for the use of the cannabis plant only for medicinal purposes, in medicines, preparations and substances, with medical prescription (INFARMED, 2019).

Thus, foods derived from the Cannabis sativa L plant authorized to be marketed in the European Union, and which have a history of safe and significant consumption, are those derived exclusively from hemp seeds, namely seed oil, hemp protein, hemp flour, and always with the premise that they come from varieties of Cannabis sativa L containing THC less than 0.2% (w / w) and provided that they do not present health claims and therapeutic properties on their labeling / advertising.

Thus, and in accordance with the requirements of Regulation (EU) No. 2015/2283, on Novel Foods and Food Ingredients, the flowers, leaves and extracts of any part of the Cannabis sativa L plant, as well as foods to which they have these parts and / or extracts have been added are new foods and in order to be placed on the market they will have to go through the authorization procedure, as established in Regulation (EU) No. 2015/2283, to which a risk analysis will be carried out by the Security Authority European Food Policy (EFSA).

Regarding the use of cannabinoids, namely cannabidiol (CBD) and delta-9-tetrahydrocannabinol (THC), cannabigerol (CBG), cannabinol (CBN) and others, used in food, like plant parts and their extracts, are considered new unauthorized foods (COM, 2019), with no history of significant and safe consumption in the European Union being demonstrated before 15 May 1997. Thus, the marketing of foods with these substances is not authorized.

Several studies of the effects of cannabis sativa L and cannabinoids on human health involve both therapeutic, adverse or toxic aspects. There is still no definitive scientific or medical consensus regarding the damages or benefits of its use.

Attention! Since November 2001, the acquisition, possession and consumption of drugs is no longer considered a crime in Portugal. Consumption was decriminalized, but not decriminalized. Consuming illicit psychoactive substances, remains an act punishable by law, however it ceased to be a target of criminal proceedings (and as such dealt with in the courts) and became a social offense.

This change in Portuguese legislation, commonly called the Law on the decriminalization of consumption (Law nº30 / 2000, of 29 November) changed the way we look at a drug user, leaving aside the prejudice that compared him to a criminal, passing to consider you as a person who needs help and expert support.

Nos últimos anos tem-se verificado um aumento da procura e disponibilização no mercado nacional de géneros alimentícios e de produtos fitoterápicos nos quais na sua composição consta a planta Cannabis sativa, as suas sementes, extratos, óleos, ou apenas as suas substâncias químicas de forma isolada como o canabidiol (CBD) ou outros canabinoides.
Os produtos comercializados pela Plant&Hemp são à base de cânhamo com um teor de tetra-hidrocanabiol – THC das superfícies (caule e sementes) inferior a 0,2%(w/w)

A Comissão Europeia considera que os géneros alimentícios com extratos de qualquer parte da planta Cannabis sativa L, bem como alimentos aos quais tiverem sido adicionados extratos de Cannabis sativa L (por exemplo óleo das sementes, são novos alimentos autorizados, desde que o teor de tetra-hidrocanabiol – THC das superfícies (caule e sementes) das variedades de plantas utilizadas não exceda os 0,2%(w/w), conforme prevê o Regulamento (UE) nº1307/2013 de 17 dezembro. No entanto, a Comissão Europeia considera que deverão ser atendidas as legislações especificas de cada Estado-Membro relativas às restrições de colocação no mercado da canábis como alimento ou como ingrediente de alimento (COM, 2019).
Em Portugal, o Decreto-Lei n. 15/93, de 22 de janeiro, que define o regime jurídico aplicável ao tráfico e consumo de estupefacientes e substâncias psicotrópicas, e o Decreto Regulamentar nº 61/94, de 12 de outubro, que estabelece as regras relativas ao controlo do mercado lícito de estupefacientes, substâncias psicotrópicas, precursores e outros produtos químicos suscetíveis de utilização no fabrico de droga, compreendidos nas tabelas I a VI anexas ao Decreto-Lei nº 15/93, de 22 de Janeiro. Estes diplomas proíbem o cultivo de cânhamo (Cannabis sativa L) sem excecionarem o cultivo das variedades que se destinam a fins industriais. Contudo, a mais recente legislação (a Lei nº 8/2019, 23ª alteração ao Decreto-Lei nº15/93 de 22/01, que aprovou o regime jurídico aplicável ao tráfico e consumo de estupefacientes e substâncias psicotrópicas, e que transpõs a Diretiva (UE) 2017/2103, do Parlamento Europeu e do Conselho, de 15 de novembro, prevê a utilização da planta canábis apenas para fins medicinais, em medicamentos, preparações e substancias, com prescrição medica (INFARMED, 2019).

Assim, os alimentos derivados da planta Cannabis sativa L autorizados para ser comercializados na União Europeia, e que apresentam histórico de consumo seguro e significativos, são os provenientes exclusivamente das sementes do cânhamo, nomeadamente óleo de sementes, proteína de cânhamo, farinha de cânhamo, e sempre com a premissa que sejam provenientes de variedades de Cannabis sativa L contendo THC inferior a 0,2% (w/w) e desde que não apresentem na sua rotulagem/publicidade alegações de saúde e propriedades terapêuticas.
Desta forma, e de acordo com o previsto nos requisitos do Regulamento (UE) nº 2015/2283, relativo a Novos Alimentos e Ingredientes Alimentares, as flores, folhas e extratos de qualquer parte da planta Cannabis sativa L, bem como alimentos aos quais tiverem sido adicionados essas partes e/ou extratos são novos alimentos e para poderem ser colocados no mercado terão que passar pelo procedimento de autorização, conforme estabelecido no Regulamento (UE) nº 2015/2283, aos quais será efetuada uma análise de risco pela Autoridade de Segurança Alimentar Europeia (EFSA).
Relativamente à utilização de canabinoides, nomeadamente canabidiol (CBD) e o delta-9-tetraidrocanabinol (THC), cannabigerol (CBG), cannabinol (CBN) e outros, usados em alimentos, à semelhança das partes de planta e seus extratos, são considerados novos alimentos não autorizados (COM, 2019), não tendo sido demonstrado até à data historial de consumo significativo e seguro na União Europeia antes de 15 de maio de 1997. Assim, a comercialização de alimentos com estas substâncias não está autorizada.
A Viriditas Et Veritas Lda e o seu sítio Plant&Hemp, não comercializam estas substâncias como cannabis sativa L e canabinioides nos alimentos ou como suplementos alimentares ou para consumo humano.
Vários estudos dos efeitos da cannabis sativa L e canabinioides na saúde humana envolvem tanto aspetos terapêuticos quanto adversos ou tóxicos. Ainda não se possui um consenso científico ou médico definitivo quanto aos prejuízos ou benefícios de sua utilização.

Atenção! Desde novembro de 2001 que a aquisição, a posse e o consumo de drogas deixou de ser considerado crime em Portugal. O consumo foi descriminalizado, mas não despenalizado. Consumir substâncias psicoativas ilícitas, continua a ser um ato punível por lei, contudo deixou de ser um comportamento alvo de processo crime (e como tal tratado nos tribunais) e passou a constituir uma contraordenação social.

Esta mudança na legislação portuguesa, vulgarmente chamada de Lei da descriminalização do consumo (Lei nº30/2000, de 29 de novembro) alterou a forma como se olha para um consumidor de drogas, deixando de lado o preconceito que o comparava a um criminoso, passando a considera-lo como uma pessoa que necessita de ajuda e apoio especializado.
A posse de cannabis é punida como contraordenação, caso se destine a consumo pessoal, limitando-se a 25g de flor, 2,5g de liamba e 2,5g de Óleo de Cannabis. Os limites são definidos por 10 doses diárias e se forem excedidos é considerado crime, podendo ser de consumo de droga ou tráfico de drogas.
