While the short answer is simple, we wouldn’t sell them if they weren’t, we know you want more information than that, and we are here to provide the answers you seek.
So, let’s get into it. We’re going to focus on three countries, Australia, the UK, and the USA, and explore whether CBD products are legal in each one.
For the sake of comfort to those of you who care about such things (we know you’re there, we’ve got your back) we are going to take these three countries in alphabetical order.
Are CBD Products Legal in Australia?
We’re starting with the most complex of the three countries we’ll cover here (it gets simpler after this).
Basically, CBD products are legal for medicinal reasons in Australia, but getting hold of them is far from straightforward.
In a 2016 Act, the Australian Government legalised CBD for medical use, sort of, but there are numerous caveats attached to this legalisation.
As a result, there are very few Australian citizens who are prescribed CBD products. This means thousands of Australians are thought to use CBD products that they have obtained illegally.
First and foremost, we want to state clearly that we do not endorse or condone illegally purchasing CBD products. Regulation is important in the CBD industry, and if the product you are using did not come from a trusted source, there are risks.
It is expected that Australian CBD laws will loosen up in time, and products will be easier to get. At the moment, we don’t know when, or even if this will happen. But when we know, rest assured, you will too.
Are CBD Products in the UK?
This is where things get simpler. Yes, CBD products are legal in the UK. As long as the product follows EU regulations, which state no CBD product can contain a THC level higher than 0.2%, and any CBD products sold in the UK must also be derived from an industrial hemp strain that has EU approval.
Quick side note here, obviously as we don’t know what is going to happen with Brexit (which puts us in the same position as you, all other UK citizens, and, seemingly, the UK and EU Governments) these laws may change.
However, there are not any changes expected as a result of Brexit, and again, if any become apparent, we’ll let you know immediately.
But as long as things stay as they are, then as long as you are buying your CBD products from a reliable source (which we cannot advise enough) then you’re fine. Whether you are using oils, vaping CBD, or you prefer any other CBD product you find on our pages, at any strength you choose, your actions are completely legal.
Are CBD Products Legal in the USA?
Up until November 2018, this would not have been as simple a question to answer. But that changed when the 2018 Farm Bill that was passed in the US towards the end of 2018, legalising CBD products in the country.
The regulations of CBD products in the US is very similar to that in the UK, with products containing less than 0.2% THC being legal.
This is a federal law, but CBD is not obtainable easily in all states. Some state laws are very strict on who can, and more importantly can’t sell CBD products, so it’s worth checking local laws where you are.
With the majority of states (33 at the time of writing) having legalised medical marijuana, and 10 legalising recreational marijuana use, it is more than likely that some states will relax these regulations further.
Regardless of whether that happens, all you need to know is that the products on these pages are 100% legal in most of the United States, and we can safely assume more states will be added to that list in the near future.
What Happens Next?
With EU law covering many European countries, CBD is legal in most of Europe, and this is starting to spread across the world.
Australia may well be the next country to take on the kind of regulation that Europe and the USA have, but it shouldn’t be long until more countries join the party.
It is an interesting time for the CBD world, because we are undoubtedly at the beginning of something of a revolution.
The impact the legalisation of CBD products will have, and how far it will spread across the globe, remains to be seen. What we know for sure though, is that it’s going to be one hell of a journey, and we can’t wait to take it with you!
